Welcome to the Cuenca Expat HUB Beta Tester Program ("Program"). These Terms and Conditions ("Terms") govern your participation as a Beta Tester in this Program. By accessing or using the Cuenca Expat HUB platform as a Beta Tester, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

Your participation in the Cuenca Expat HUB Beta Tester Program constitutes your full acceptance of these Terms. If you do not agree to these Terms, you must not participate in the Program.

2. Nature of the Beta Program

The Cuenca Expat HUB platform is currently in a beta testing phase. This means it is under development and may contain bugs, errors, or incomplete features. Your participation is invaluable in identifying these issues and helping us refine the platform. You understand and agree that the platform is provided "as is" and "as available," without warranties of any kind.

3. Beta Tester Responsibilities

As a Beta Tester, your collaboration is essential. You are expected to assist with the following:

• Engagement and Content Contribution: Actively participate within the Cuenca Expat HUB communities (both public HUBiteers and Premium Groups). This includes contributing valuable insights, asking relevant questions, and fostering positive discussions. We expect a minimum standard of two (2) high-value posts per month or four (4) promotional posts per month within the communities. To avoid spamming, please do not exceed the four (4) promotional posts per month.

• Timely Survey Participation: Respond to surveys accurately and promptly as requested by the Cuenca Expat HUB team. Your input will guide platform development and future content.

• Platform Promotion: Make a good faith effort to promote the Cuenca Expat HUB platform and its offerings to your network, as appropriate. While no specific promotional goals are set, your active support is appreciated.

4. Commission for Premium Community Referrals

As a benefit of your Beta Tester status, you are eligible to receive a 50% commission (after platform fees) for each new member who subscribes to the Cuenca Expat HUB Premium Community Groups directly through your unique affiliate link. This personalized affiliate link will be provided to you via email. Commissions will be calculated and disbursed according to a schedule to be communicated separately.

5. Individual Collaborations and Arrangements

Cuenca Expat HUB may enter into specific, separate arrangements or collaborations with individual Beta Testers. These arrangements may include, but are not limited to, clauses regarding commissions for referred business to the Beta Tester if they operate a business. Any such arrangements will be formalized in a separate written agreement, which will supersede these Terms only to the extent explicitly stated within that separate agreement.

6. Data Ownership and Usage

All data, feedback, suggestions, and information gathered through the Cuenca Expat HUB system during your participation as a Beta Tester (including, but not limited to, survey responses, community engagement data, and bug reports) shall be the sole property of the Cuenca Expat HUB Group. There is no contractual obligation for Cuenca Expat HUB to share this data or information with any Beta Tester.

7. Privacy of Personal Information

Cuenca Expat HUB is committed to protecting your privacy. Personal information collected from Beta Testers will be handled in accordance with our Privacy Policy (link to be provided separately on the website). We explicitly state that personal information from Beta Testers will not be sold, exchanged, given away, or traded with any third parties.

8. Prohibited Conduct

Beta Testers are strictly prohibited from:

• Promoting External Pages or Groups: No promotion of external websites, social media groups, businesses, or services is permitted within any part of the Cuenca Expat HUB platform (including communities, comments, or private messages), unless explicitly pre-approved in writing by the Cuenca Expat HUB Group.

• Spamming: Engaging in any form of unsolicited or repetitive communication that disrupts the community or other users.

• Disruptive Behavior: Any conduct that is harmful, offensive, or interferes with the proper functioning of the platform or the enjoyment of other users.

• Misrepresentation: Falsely representing yourself or your affiliation with Cuenca Expat HUB.

9. Termination of Beta Testing

Your participation in the Beta Tester Program is at the sole discretion of the Cuenca Expat HUB Group. There is no contractual obligation or specific legal relationship implied by your Beta Testing status per se.

Your Beta Testing status will be terminated immediately upon any breach of these Terms or any separate agreement you may have with the Cuenca Expat HUB Group. In the event of termination due to a breach, no specific remuneration, compensation, or outstanding commissions (if any) shall be demandable from the Cuenca Expat HUB Group.

10. Limitation of Liability

Cuenca Expat HUB Group shall not be liable for any damages, direct or indirect, arising from your participation in the Beta Program, including but not limited to, loss of data, loss of profits, or business interruption. Your use of the platform is at your sole risk.

11. Changes to Terms

Cuenca Expat HUB reserves the right to modify these Terms at any time. We will notify you of any significant changes by posting the updated Terms on the platform or by email. Your continued participation after such notification constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ecuador, specifically within the jurisdiction of Cuenca, Azuay.
